Wording for requirement of "Nachweis zur Eignung
nach RAL-GZ 961" (i.e. evidence of eligibility pursuant to
RAL-GZ 961)
The following wording is used largely in this form by clients to set out the eligibility requirement in procurement processes:
Evidence of eligibility of the company (evidence pursuant to sec. 6 (3) no. 3 VOB/A)
When submitting bids*) and during performance of the work bidders must demonstrate the technical qualification (specialist knowledge, technical performance capability, reliability in terms of technical fulfilment of the contract) and quality assurance of the company. The requirements of the Gütesicherung Kanalbau RAL-GZ 9611) - appraisal group**) "..." published by the Deutsche Institut für Gütesicherung und Kennzeichnung e.V. must be met and compliance demonstrated with submission of the bid.
Evidence will be deemed provided if the bidder demonstrates compliance with the requirements and the quality assurance of the company pursuant to Gütesicherung Kanalbau RAL-GZ 961 by possession of the corresponding RAL Sewer Construction Quality Mark for the required appraisal group(s).
Evidence of the same standard will in particular be deemed provided if the bidder demonstrates compliance with the requirements by means of an inspection report conforming to section 4.1 of the Quality and Test Specifications for the required appraisal group(s) and, in the event of a contract, the bidder is under an obligation to reach a quality assurance agreement conforming to Gütesicherung Kanalbau RAL-GZ 961 section 4.3 and to perform the associated "self-monitoring" according to section 4.2 for the duration of the services.

Further advice on the wording by the awarding body
*) Indicate here how the evidence is to be presented. The standard practice is to demand the evidence "with submission of the bid" (see also VK Nordbayern, ruling of 27.06.2013 - 21.VK-3194-28/13). In special cases the awarding body will specify that evidence is to be presented "on the demand of the awarding body from submission of the bid to (date/time)". The deadline (date, time) for presentation of the evidence should be before the end of the evaluation period.
